Sevona collects the following general types of information about you when you visit our Sites: personal information, demographic information, behavioral information, and indirect information. We may collect combinations of all these types of information. Personal information is information that can be used to identify you or any other individual. We do not collect personal information unless you choose to provide it to us. Some examples of personal information that we collect are your name, address, email address, telephone number, credit card number or billing information; and information about third parties, such as references or contacts, that you provide to us. Demographic information is information that is not unique to you in the sense that it refers to selected population characteristics, such as your ZIP code or postal code, age, preferences, gender, race or ethnicity, occupation, interests and favorites.
Sevona also collects, or logs, certain other information that cannot identify you personally when you visit our Sites. This information includes your Internet Protocol (“IP”) address, unique mobile device ID and other information such as your browser type. An IP address is a number that is automatically assigned to your Internet connection by your Internet service provider. Sevona may log IP addresses, device IDs, and browser specific information, and aggregate this information for Sites administration. We use the aggregated information to measure the number of visits to our Sites, the average time spent on our Sites, the number of pages viewed, and various other site use statistics. This monitoring helps us evaluate how our Sites is used and continuously improve the content we provide.
At other times, Sevona may collect information that cannot be used to identify you. For example, we may aggregate non-personal information about visitors to our Sites. Aggregated information will not contain any information that can be linked directly back to you.
Sevona may use any number of tools to collect information about you, your computer access points, and the web browser that you use to connect to our Sites. For example, “cookies” are tiny text files that we place on your computer’s hard drive when you visit our Sites. You do not have to accept our cookies and you may delete them after they have been placed on your hard drive. If you do not accept our cookies, or if you delete our cookies, some areas of our Sites that you access may take more time to work or may not function properly.
Sevona may also collect additional information from your web browser each time you visit our Sites. This information may include the type of browser, the time that your browser was used to access our Sites, and the referring web site address. We may collect information on the pages that you visit and other actions that you take while using our Sites.
Our Internet Service Providers (defined below) may also use other standard web-based technologies to analyze your movements while accessing our Sites. The technologies include web “beacons,” “pixel tags,” and “clear gifs.” These technologies help us rate the effectiveness of our product and service programs, allow us to customize the services offered on or through our Sites, and help determine the best use for Sites content. Some of this information, including the IP address, may be stored on our Internet service provider’s server logs, and may be available for extended periods of time.
We may share your information with third parties who help us deliver our products and services to you. These uses include third parties who assist in hosting our web servers, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service (“Internet Service Providers”). These companies and individuals may be located in countries whose data protection legislation is different from the United States, and they will have access to your personal information as necessary to perform their functions, but they may not share that information with any other third party or use that data for any other purpose without our consent. We also share aggregated anonymous information about visitors to the Sites with Sevona’s partners and other third parties so that they can understand the kinds of visitors to the Sites and how those visitors use the Sites.
If you indicate that you would like to receive information about the opportunities, products or services of third parties, we may supply your contact information to select third parties such as data aggregators, marketers or others for the purpose of sending you email or otherwise communicating with you. We use data we have about you (such as the interests and preferences you have expressed in connection with registration) to determine whether you might be interested in the opportunities, products or services of a particular third party.
We may disclose and transfer your personal information to a third party who acquires all or a substantial portion of Sevona’s business, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In addition, in the event Sevona becomes the subject of bankruptcy or an insolvency proceeding, whether voluntary or involuntary, Sevona or its liquidator, administrator, receiver or administrative receiver may sell, license or otherwise dispose of such information in a transaction approved by the court. You may not be notified directly of a sale or a bankruptcy/insolvency proceeding. In addition, when a potential buyer is interested in purchasing one of our properties, we may provide the potential buyer with information about the property and the residents who live there, which may include your personal information. Upon the sale of the property in which you live, all of your personal information may be transferred to the purchaser.
If we offer, and you choose to enter a sweepstakes, contest or other promotion, your personal information may be disclosed to third parties in connection with the administration of such promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law, such as on a winners list. Also, by entering a promotion, you are agreeing to the official rules that govern that promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor(s) of the promotion to use your name, voice and/or likeness in advertising or marketing associated with the promotion.
Additional uses of your non-personal and personal information will allow us to tailor content and other services that are specific to your needs, to help organize and manage our relationships and business, to conduct business, to provide you with customer support, to perform functions that are described to you at the time of collection, and to enforce our Sites’ Terms.
Sevona may also disclose your personal information as is necessary to: (a) comply with a subpoena or court order; (b) cooperate with law enforcement or other government agency; (c) establish or exercise our legal rights; (d) protect the property or safety of our companies s and employees, contractors, vendors, and suppliers; (e) defend against legal claims; (f) help with internal and external investigations; or (g) as otherwise required by law or permitted by law.
Sevona makes reasonable efforts to ensure that our Internet Service Providers have implemented physical, electronic, and procedural security measures to assist with safeguarding your personal information, and to help protect against unauthorized access and disclosure. Only our authorized personnel and our Internet Service Providers, who perform legitimate business functions for Sevona are authorized to access your personal information. Notwithstanding our efforts, the Internet has inherent security risks. Sevona cannot promise, and you should not expect, that your personal information transmitted via the Internet, Internet searches, and other Internet communications will always remain secure.
Sevona’s Sites are a general information website. Sevona’s content is neither directed toward minors, or anyone under the age of majority in an individual’s state of residence. We do not knowingly collect personal information from minors, or any one under the age of majority. If Sevona or its Internet Service Providers become aware that a minor or individual under the age of majority has provided us with personal information, that information will be deleted from our databases.
Sevona will not share any personal information about you with outside third-parties for their direct marketing purposes to the extent prohibited by California law, unless you agree otherwise as authorized by your prior written consent.
California residents have the right to request information from Sevona regarding the manner that we may share personal information with affiliated companies and third parties for their direct marketing purposes. To find out what and how we share such information, you may send our Privacy Officer a request by e-mail at email@example.com or by U.S. Mail at 2400 E. Katella Ave., Suite 370, Anaheim, CA 92806. If you do so, we will provide the following information:
A. The categories of information we disclosed to third parties for their direct marketing purposes during the preceding calendar year, if any;
B. The names and addresses of the third parties who received information for their direct marketing purposes; and
C. Examples of the products and services subject to the third-parties’ direct marketing programs, if the nature of the third parties’ business cannot be determined from their names.
The first time that you provide us with registration information through our Sites, you may be offered the opportunity to subscribe to and receive additional information about our communities. After your first use, you can change your initial choices by contacting our customer service email at firstname.lastname@example.org. Each commercial email that we send to you, will offer you the opportunity to opt-out of continuing to receive such messages. We may take up to 10 business days to process your opt-out requests. In some instances, we may have already shared your information with one of our authorized third parties before you changed your information preferences. In those cases, you may have to directly contact those third parties to opt-out of receiving their communications. FTC email compliance guidance allows us to send you transactional and relationship email without offering you the opportunity to opt-out of receiving those types of email.
If you would like to opt out of any of our marketing programs, or wish to withdraw your consent to us contacting you via your e-mail, fax or phone number, or if your personal details change, please contact us through one of the following: (i) by telephone, at 714-786-5000 and ask for our Sevona Website Director; (ii) by facsimile, at 714-786-6580; (iii) by e-mail, by following the Opt-Out instruction contained in the body of any marketing e-mail from us or by sending us an e-mail at email@example.com that includes a copy of the e-mail you have received and includes “Remove” in the subject line of your e-mail; or (iv) by U.S. Mail, care of Sevona Website Director, Sevona Apartments, 2400 E. Your election not to receive newsletters or promotional and marketing correspondence from us will not: (a) preclude us from corresponding with you, by e-mail or otherwise, regarding your existing or past relationship with us, or (b) preclude us, including our employees, contractors, agents and other representatives, from accessing and viewing your personal information in the course of maintaining and improving the Sites.
